Michigan Healthcare Rights Remain Protected Despite Federal Uncertainty
LANSING – Michigan Attorney General Dana Nessel issued a strong reminder to healthcare providers and patients that Michigan law ensures continued access to healthcare services despite federal funding uncertainties. Her statement follows a series of executive orders issued by President Donald Trump restricting healthcare options for minors and threatening to pull federal funds from healthcare facilities.
Nessel’s open letter, released on February 7, 2025, clarifies that federal funding availability does not affect the legal obligation of Michigan providers to offer services without discrimination. She emphasized that Michigan law protects individuals against discrimination based on race, religion, sex, gender identity, and other protected statuses.
Federal Actions Spark Legal Challenges
In response to the federal government’s efforts to freeze funding for certain healthcare services, Michigan joined 21 other states and the District of Columbia in a lawsuit aimed at blocking these measures. On January 31, 2025, a judge issued a Temporary Restraining Order (TRO) preventing federal agencies from freezing or blocking grants without following applicable laws.
“Simply put: If you are seeking healthcare, continue to do so. If you are providing healthcare in compliance with Michigan law, please continue to do so,” Nessel stated in an accompanying video message.
Michigan Law Overrides Federal Restrictions
Nessel’s guidance underscores that Michigan laws, specifically MCL §§ 37.2102, 2202, 2302, prohibit discrimination in healthcare services. Her letter noted that any refusal of care based on gender identity or other protected statuses could constitute illegal discrimination under state law.
The Attorney General’s office acted swiftly after the federal government’s announcement, seeking legal intervention to ensure continued healthcare access. The TRO issued by the federal judge provides temporary relief while litigation proceeds.
Healthcare Providers Urged to Stay Informed
Nessel encouraged both patients and providers to consult legal counsel to better understand their rights and obligations. The letter aims to prevent misinformation and reassure healthcare workers that state protections remain intact.
